According to the Spanish law passed on the 1st of June of 2013, all properties for sale and rent must have an energetic certification.

Breaking this law regarding the energetic efficiency of the properties could bring lots of consequences like economic fees for the owners of those properties.

According to the Royal Decree approved on the 5th of June 2013, the owners of properties for sale or rent who do not apply to this requirement will be fined with fees between 300 and 6.000€.

The Spanish law that obliges the owners of properties for rent or sale to have a valid energetic certificate is actually derived from the European regulation.

The European Union regulation is really clear and it states that all owners of properties (both rental and sale) must count with a valid energetic certificate.

Since quite a while, the government in Spain has launched a plan in order to improve the energetic efficiency of the buildings and it is based on the investment of millions of euro for a proper isolation of the properties, in order to achieve more effective and less polluting energy systems.

The Department of Industry, Tourism and Energy in Spain manage the available funds for the aid on the energetic improvements of the properties and it regulates the national level that supervises the fulfillment of the European regulation.

The government in Spain urged all the Public Administrations to count with energetic certificates for all their buildings and properties in order to stimulate the owners who want to rent and sale.

According to the law published on OSG (Official State Gazette), these are the beneficiaries of the aids in order to improve the energetic efficiency of the properties:

  • Joint ownerships of the owners of buildings not divided horizontally.

What is an energetic certificate of a property in Spain.

The energetic efficiency of the buildings is calculated by measuring the energy consumed during the years under normal conditions.

The energetic certificate of the properties is calculated by taking different variables into account, such as: their heating and freezing systems, the hot water production, the generated lightning and the ventilating system.

The energetic certificate of the properties in Spain is resulted from the calculation of the kilograms of CO2 divided by the squared meters of the property (Kg CO2/m2 per year).

The best energetic qualification that a property can receive is the grade A. The numbers must go below 6.8 kg of CO2/m2 per year. Grade G is the worst qualification that a property can get and that is when properties exceed 70.9 kg of CO2/m2 per year.

According to the valid regulation in Spain, all properties for sale and rent must count with such a certificate.

However, there are some exceptions that free the owners from that certificate, but the majority of the properties in Spain are not part of those exceptions.

For example, the energetic certificate for properties in Spain is not obligatory for:

  • Those apartments rented out for a period of less than 4 months.

  • Those isolated buildings with less than useful 50 m2 .

  • Monuments and protected buildings whose aspect and appearance might change in time.

  • Facilities used for religious purposes or cult places.

  • Temporary constructions for less than 2 years.

  • Parts of farming and industrial buildings not used as residential areas.

In the same time, the regulation on the obligatory nature of having an energetic certificate in Spain states that the latter is obligatory for:

  • All new built constructions.

  • After a renovation of a useful surface of more than 1000 m2 which will affect more than 25% of its structure.
